3. Personalised and Custom-Made Products
The statutory right of withdrawal does not apply to products which are made to your specifications or are clearly personalised.
This may include, for example:
- balloons containing a name, age, message or custom wording;
- personalised bubble balloons;
- balloons displaying a company name or logo;
- custom colour combinations specifically prepared for your order;
- custom balloon boxes;
- bespoke bouquets;
- balloon installations designed for your event;
- custom signage;
- custom backdrops;
- branded decorative elements;
- products manufactured, printed, cut or assembled to your specifications.
This exception may apply even if the item has not yet been delivered.
EU consumer-law guidance confirms that the exception for genuinely made-to-specification or clearly personalised products stems from the nature of the contract itself.
This does not affect your rights if a personalised product is defective, materially different from what was agreed, or otherwise not supplied in conformity with the contract.
