4. Products and Services

The Balloon provides products and services including, but not limited to:

• Balloon products: Balloon bouquets, balloon boxes, bubble balloons, foil balloons, latex balloons and personalised balloons.
• Custom decoration: Garlands, arches, balloon walls, backdrops, photo zones, signage and bespoke installations.
• Event decoration: Complete visual styling for private events, weddings and corporate events.
• Event services: Planning, supplier coordination, styling, setup, dismantling and other agreed event-related services.
• Destination services: Projects outside Budapest and Hungary, including projects across Europe.

The precise scope of a custom project is determined by the applicable quotation/order confirmation.

5. Product Information

We make reasonable efforts to ensure that product descriptions, photographs, dimensions, colours and other information are accurate. However, handmade and decorative products may have reasonable variations. Reference images and photographs are illustrative unless an exact specification is expressly agreed.

6. Artistic Interpretation

Custom decoration involves creative work. Moodboards, Pinterest images, Instagram posts, photographs or other references supplied by a customer indicate the desired style and direction, rather than requiring an exact reproduction. The Balloon retains reasonable artistic discretion concerning composition, balloon placement, proportions, flower placement, and structural elements.

7. Customisation and Customer Approval

The customer is responsible for checking all information supplied to us (names, dates, spelling, colours, quantities, venue details). Where a design proof is provided, production begins after approval.

8. Intellectual Property Supplied by Customers

By providing a logo, photograph, graphic, or trademark, the customer confirms that they have the necessary right or permission for us to use it for the order.

9. Availability & Substitutions

Products and materials are subject to availability. Where a substitution would materially affect the agreed design, we will seek customer approval where reasonably practicable.

11. Quotations & 12. Order Process

Unless stated otherwise, a quotation is an invitation to enter into a contract and does not itself reserve a date. An order becomes binding only when accepted by The Balloon.

13. Right to Refuse an Order

We may decline an order before a contract is concluded where reasonably necessary (e.g. unavailable products, insufficient capacity, unsafe installation, obvious pricing errors). Where payment has already been collected, it will be returned promptly in accordance with applicable law.

10. Prices

Prices are shown in the currency indicated on the website or quotation. Before conclusion of a consumer contract, applicable taxes and mandatory charges will be communicated as required by law. Additional charges may apply for delivery, installation, dismantling, waiting time, night delivery, or weekend/public-holiday service.

14. Payment Methods & Milestones

Accepted payment methods are displayed during checkout or communicated before confirmation. Depending on the project, we may require full advance payment, partial advance payment, a booking fee, or staged milestone payments before the event.

15. Deposits and Advance Payments

For custom projects, events and destination projects, the quotation will specify the nature and purpose of any advance payment or booking amount, including what the payment covers, when it becomes payable, and applicable cancellation consequences.

16. Late Payment

For staged event projects, failure to make an agreed payment on time may result in suspension of further work or exercise of contractual/statutory cancellation rights.

17. Delivery & 18. Out-of-Hours Service

We deliver throughout Budapest and surrounding areas, and provide European delivery by agreement. Early-morning, night-time, weekend and public-holiday deliveries are available by prior arrangement and may involve an additional fee.

19. Failed Delivery & 20. Customer Collection

The customer is responsible for providing accurate delivery details and access instructions. For collected orders, responsibility for transportation and care after lawful handover rests with the customer.

21. Balloon Characteristics & 22. Outdoor Decorations

Balloons are temporary decorative products affected by temperature, sunlight, humidity, and handling. Outdoor installations carry additional environmental risks, and safety takes priority over design.

23. Installation, Setup & 24. Venue Restrictions

The customer must ensure safe and timely venue access, power, permits, and approved attachment points. We may modify or refuse setups that create safety hazards or violate venue regulations.

26. Handover & 27. Damage After Handover

Completed installations should be inspected before our team leaves. The Balloon is not responsible for subsequent damage caused by guests, staff, animals, or weather after handover.

28. Event Bookings & 29. Events Across Europe

Wedding, corporate and private-event bookings reserve dedicated capacity and suppliers for specific dates. The Balloon operates across Hungary and Europe; destination projects may involve travel, accommodation, and local partner logistics.

30. Third-Party Suppliers

We coordinate third-party suppliers (florists, furniture, entertainment, custom fabrication) as outlined in the project quotation.

31. Changes & 32. Event Rescheduling

Changes or postponement requests should be communicated immediately. Rescheduling is subject to team and supplier availability; committed third-party costs remain subject to agreement.

33. Cancellation & 34. Right of Withdrawal

For eligible distance contracts, Consumers have a 14-day statutory withdrawal right. Full details and procedures are available in our separate Returns, Cancellations & Refunds Policy.

35. Personalised Goods Exception

Under EU and Hungarian consumer law, the statutory right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalised (names, custom wording, bespoke colours, tailored installations).

38. Defective or Incorrect Products

If an item is defective or does not match the agreement, please contact us promptly. Remedies include repair, replacement, price reduction, or refund pursuant to Hungarian Decree 373/2021.

39. Complaints & 40. Alternative Dispute Resolution (ADR)

Written consumer complaints will receive a reasoned substantive response within 30 days as required by Hungarian law. Consumers may also access competent conciliation bodies (békéltető testület).

42. Intellectual Property

All website content, photographs, logos, branding, and original balloon designs are protected by intellectual property laws and may not be reproduced without prior written permission.

43. Photography of Events

We respect customer privacy. While we may photograph completed decorations for our portfolio, any publication of images where clients or guests are identifiable is handled with dedicated respect for privacy rights.

44. Privacy & Personal Data

Personal data is processed strictly in accordance with our separate GDPR-compliant Privacy Policy.

45. Customer Responsibilities

Customers agree to supply truthful information and use our website and services only for lawful purposes.

46. Limitation of Liability

Nothing in these Terms limits liability where prohibited by applicable law. Subject to mandatory law, we are not liable for losses caused by incorrect customer information, customer transport, undisclosed venue restrictions, or natural balloon characteristics.

47. Indirect Loss — Business Customers (B2B)

For B2B projects, The Balloon is not liable for indirect or consequential loss, loss of profits, or business interruption, and total liability is capped at the project contract value.

48. Force Majeure

Neither party is in breach for delays caused by circumstances beyond reasonable control (severe weather, natural disasters, transport strikes, government measures, venue closures).

49. Website Availability & 50. Obvious Errors

Temporary maintenance may occur. Obvious technical or pricing errors will be handled fairly in accordance with applicable contract principles.

51. Changes to Terms & 52. Severability

Terms applicable to an order are those accepted when the contract was concluded. If any clause is held invalid, the remainder remains fully enforceable.

54. Governing Law & 55. Jurisdiction

These Terms are governed by Hungarian law, without prejudice to mandatory consumer conflict-of-law protections for European residents.

56. Language & 57. Entire Agreement

Translations are provided for convenience. The contract consists of these Terms, accepted quotation, and project specifications.
